Copyright is available to artistic works as per Section 13 of the Copyright Act, 1957. Artistic work includes a photograph.
If copyright is available for photographs, then who owns it?
According to Section 17(b) of the Act, in the case of a photograph taken for a valuable consideration (payment) at the instance of any person, such person shall, in the absence of any agreement to the contrary, be the first owner of the copyright therein.
